Dear friends,
On Wednesday the 6. senate of the supreme administration court in Berlin decided to cancel the directive of the state Niedersachsen (Lower Saxony) with its breed list. (Another senate made some weeks ago a contrary decision for the state Brandenburg). The judges say that the content goes to far for a directive which
is made by a minister. The content infringes too deep in the rights of the people, so it needs a law, which has to pass a state parliament.
But it is not only this point the judges critisized. For the first time since the breed lists in Germany has been come to force two years ago it was stated that there is no scientific evidence that a breed is more dangerous than another. The judges overtake the scientists result that it needs a lot of components which make a dog dangerous. This is very important, because it is a hint for the politician not to make new laws now with the content of the directivs e.g. with breed lists.
I expect that now more directives from other states will be cancelled (e.g. the revision against the directive of the state Baden-Wuerttemberg and my revision against the so called fighting dog tax will be successful). Keep the fingers

The highest administration court in Berlin heard the appeal of the Lower Saxony Dangerous Dog Law (Rudi was there today)...
The ENTIRE dog law was thrown out..no more breed list, no more steralizations, muzzles and short leashes!!!
This is the same court we are taking the trial for the Bull Terrier to, to remove him from the national breed list.
This sent a message to the other 15 states in Germany that their dog laws may also not hold. I will send a more updated message tomorrow on what happened in the court room.
Rudi and I are very happy..today our dogs are no longer dangerous in Lower Saxony and can walk freely on the street tomorrow. It is a very positive step by this high court and sends a signal to all the politicians. Rudi and I think this will make our fight to remove the Bull Terrier from the Federal Breed Ban list much easier!

The Domino Deutschland and the German Kennel Club will be meeting next week and
hope they will agree to work together against the current anti-dog laws.
The situation in North Rhine-Westphalia has become worse: The government has
presented a new Dangerous Dog Law, which is much more restrictive than
previously. It will strictly forbid anyone to let any dog bigger than 40
centimetres or greater than 20 kilogram in weight off the lead except on your
their own property.
The penalties are even more draconian than before and reach up to 100 000 Euro
(£50,000). It is hoped that a translation of the draft of the new law will be
available soon.
